Welcome to MINACHAT. These Terms of Service ("Terms") govern your use of the MINACHAT mobile application ("Service") operated by MINACHAT ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility

• You must be at least 18 years old to use MINACHAT.
• By confirming your age during onboarding, you represent that you are 18 years of age or older.
• Misrepresentation of age will result in immediate account termination.
• We do not knowingly allow access to anyone under 18.

2. Account Registration

• You may create an account using Google Sign-In, Apple Sign-In, or email verification.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• One account per person. Creating multiple accounts to circumvent restrictions is prohibited.

3. Description of Service

MINACHAT provides an AI character companion platform where you can:

• Discover and interact with AI characters via text chat and voice call.
• Create custom AI characters with AI-generated avatars.
• Create and share roleplay scenes.
• Participate in group conversations with multiple AI characters.
• Build relationships through the affinity progression system.

4. User Conduct

You agree NOT to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Generate, share, or distribute content that exploits, abuses, or endangers minors in any way.
• Use the Service to harass, threaten, or harm any real person.
• Attempt to extract, reverse-engineer, or replicate the AI models or proprietary technology used by the Service.
• Use automated systems (bots, scrapers) to access the Service without authorization.
• Impersonate any real person (living or deceased) when creating characters, without clear fictional context.
• Share your account credentials or allow others to access your account.
• Circumvent any content moderation, safety filters, or age-gating systems.
• Upload malicious content, viruses, or code designed to disrupt the Service.

5. Content Guidelines

5.1 User-Created Content

When creating characters, scenes, or other content, you must ensure:

• Content does not depict real individuals without their consent.
• Content does not promote violence, hate speech, or discrimination.
• Public content (characters, scenes marked as public) follows community guidelines.
• You own or have the right to use any images uploaded as character avatars.

5.2 AI Interaction Content

• AI characters respond based on their configured personality and the affinity gate system.
• Content progression is managed by the affinity tier system — content becomes more mature as the relationship develops.
• Age-appropriate content safeguards are applied based on the user's declared age range.
• We reserve the right to moderate AI-generated content and adjust safety filters at any time.

5.3 Prohibited Content

• Content that sexually exploits or endangers minors (CSAM). This will be reported to relevant authorities.
• Content that promotes terrorism, self-harm, or suicide.
• Content that constitutes illegal activities (drug trafficking, weapons trade, etc.).
• Non-consensual intimate imagery of real people.

6. Intellectual Property

6.1 Our Property

The Service, including its design, code, features, AI systems, and branding (MINACHAT name, logo, UI elements) are the property of MINACHAT and are protected by intellectual property laws.

6.2 Your Content

• You retain ownership of original content you create (character concepts, story ideas, original text).
• By publishing content as public (characters, scenes), you grant MINACHAT a non-exclusive, worldwide, royalty-free license to display, distribute, and promote that content within the Service.
• AI-generated content (images, text, voice) is generated using third-party AI services and may be subject to their respective terms.
• You may not claim exclusive ownership of AI-generated images or text.

7. Virtual Currency and Purchases

• Sparks (💎) are virtual currency used within the Service.
• Virtual currency has no real-world monetary value and cannot be exchanged for real currency.
• Purchases of virtual currency are final and non-refundable, except as required by applicable law or Google Play / Apple App Store policies.
• We reserve the right to modify pricing, availability, and the virtual economy at any time.
• Unused virtual currency will be forfeited upon account deletion.

8. Push Notifications

• The Service may send push notifications including character messages, daily streak reminders, and engagement prompts.
• You can manage notification preferences in Settings → Notifications.
• You can disable all notifications through your device's system settings.

9. Third-Party Services

The Service integrates with licensed third-party providers for authentication, cloud storage, AI character generation, image creation, and voice synthesis. Your use of these integrated services is also subject to their respective terms and policies.

10. Disclaimers

• The Service is provided "as is" and "as available" without warranties of any kind.
• AI-generated content may contain inaccuracies, inconsistencies, or inappropriate material despite safety filters.
• We do not guarantee uninterrupted or error-free service.
• AI characters are not real people and should not be relied upon for medical, legal, financial, or psychological advice.
• We are not responsible for emotional attachment or dependency on AI characters.

11. Limitation of Liability

To the maximum extent permitted by applicable law, MINACHAT shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or emotional distress, arising from your use of the Service.

12. Account Suspension and Termination

• We reserve the right to suspend or terminate your account at any time for violation of these Terms.
• You may delete your account at any time through Settings → Delete Account.
• Upon termination, your right to use the Service ceases immediately.
• Provisions regarding intellectual property, limitation of liability, and dispute resolution survive termination.

13. Modifications to Terms

• We may update these Terms from time to time.
• Material changes will be communicated via in-app notification at least 14 days before taking effect.
• Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
• If you disagree with the changes, you must stop using the Service and delete your account.

14. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first, then through binding arbitration if necessary.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
